Abstract

The socio-educational measures that are imposed on adolescent offenders, who have committed a crime classified in the Comprehensive Organic Penal Code, lack clear regulation in the Code of Childhood and Adolescence so that judges specialized in adolescent offenders can apply them in correspondence with the damage caused to the victim. Therefore, this research will develop parameters that allow the principle of proportionality to be applied when imposing socio-educational measures on adolescent offenders and the objectives established within the restorative justice model can be achieved, avoiding the discretion of the Judge of adolescent offenders.
