| Abstract: | The present academic document on “Crime of Fraud through the technological use of Deepfake” has been prepared due to the high number of scams that occurred in 2024, using the Deepfake method on digital platforms; since the problem is that in these cases the Ecuadorian justice system sanctions it only as a concurrent approximation of identity theft.The importance of transforming the legal body by developing a robust legal framework within the Comprehensive Organic Criminal Code is highlighted, in which an article of the particularities that occur through Deepfake is introduced or classified as an autonomous crime in the COIP and thus the misuse of this method can be sanctioned and prevented through an effective procedure of the justice system. |
| Description: | Se ha llevado a cabo la elaboración del presente documento académico sobre “Delito de Estafa mediante el uso tecnológico del Deepfake”, debido al alto número de estafas transcurridas en el año 2024, utilizando el método Deepfake en plataformas digitales; ya que el problema es que en estos casos el sistema de justicia ecuatoriana lo sanciona solo como una aproximación concurrente de suplantación de identidad. Se destaca la importancia del transformar el cuerpo legal desarrollando un marco jurídico robusto dentro del Código Orgánico Integral Penal, en el cual se introduzca o tipifique un artículo de las particularidades que se dan mediante Deepfake como un delito autónomo en el COIP y así se pueda sancionar y prevenir el uso indebido de este método mediante un procedimiento eficaz del sistema de justicia. |
