Abstract

This paper addresses a complex legal issue: the regulation of the use of tinted windows in Ecuadorian vehicular transport. Although the Traffic Law requires vehicles to provide interior visibility, the regulations lack clear technical parameters and create discretionary enforcement. This ambiguity has led to arbitrary sanctions, conflicts between users and authorities, and the violation of fundamental rights such as legal certainty, due process, and the personal protection of citizens exposed to situations of violence. The central objective of the research was to analyze the current regulations on tinted windows and their practical application, in order to identify legal and technical gaps that affect the coherence of the legal system. Specific objectives include evaluating the national and international regulatory framework, studying the control procedures exercised by traffic authorities, and formulating regulatory guidelines that integrate objective technical criteria with constitutional guarantees. The focus was oriented toward building a balance between citizen security and individual rights. The main findings reveal that current regulations are insufficient, as there is no uniformity in controls and most operations are carried out without certified measuring equipment, which leads to subjective decisions. The paper concludes that legal and technical reforms are needed to unify criteria, define clear luminous transmittance standards, and establish transparent procedures that allow for justified exceptions. This would strengthen citizen security, guarantee personal protection, and restore legitimacy to the institutions responsible for enforcing the regulations.
