La implementación de pruebas poligráficas en la evaluación de Jueces y Fiscales en Ecuador.

Abstract

This research analyzes the constitutional feasibility of implementing mandatory polygraph tests in the periodic evaluations of judges and prosecutors in Ecuador. The study identifies issues of trust and legitimacy within the judicial system, as well as the lack of effective anti-corruption control mechanisms. Through a doctrinal, normative, and jurisprudential approach, a proposal is made to reform the Organic Code of the Judicial Function (COFJ) to include the polygraph as an administrative control tool, ensuring confidentiality of results and their non-probative character. The research concludes that such a measure is legally viable, strengthens transparency, and contributes to improving public confidence in the judicial function.
