Résumé: This research paper analyzes how, starting in 2018, Ecuadorian migration policy shifted to a restrictive stance in response to the massive influx of Venezuelan citizens, prioritizing national security over a human rights-based approach. The compatibility of the regulatory requirements imposed on the Venezuelan population (2018-2025) with the constitutional principles of universal citizenship and state sovereignty is assessed to determine whether their scope is consistent with international standards that the State must uphold, considering its duties of respect, guarantee, and non-discrimination. Using a qualitative methodology, executive decrees and ministerial agreements on migration regularization were contrasted with the 2008 Constitution and the Constitutional Court's recent rulings. The results evidence a critical tension in which the sovereign power of migration control has led to regressive, potentially discriminatory measures, such as the imposition of visas and exclusionary regularization processes, that contravene the right to freedom of movement and the principle of universal citizenship. It is concluded that the enforced policies drain the principle of universal citizenship of its substance, transforming the exception into the rule and fostering irregular migration, which requires a regulatory reconfiguration aligned with the constitutional block.
Description: El presente trabajo de investigación analiza cómo, a partir del año 2018, la política migratoria ecuatoriana experimentó un giro restrictivo frente al flujo masivo de ciudadanos venezolanos, priorizando la seguridad nacional por encima del enfoque de derechos humanos. Se examina la compatibilidad de las exigencias legislativas impuestas a la población venezolana (2018-2025) con los principios constitucionales de ciudadanía universal y soberanía estatal para determinar si su alcance se ajusta a los estándares internacionales que el Estado debe cumplir, teniendo en cuenta sus obligaciones de respeto, garantías y no discriminación. Utilizando un método cualitativo, se contrastaron decretos ejecutivos y acuerdos ministeriales sobre legalización de la inmigración con la Constitución de 2008 y los estándares fijados por las últimas decisiones de la Corte Constitucional. Los hallazgos muestran una tensión crítica donde el poder soberano del control de la inmigración ha llevado a medidas legales regresivas y potencialmente discriminatorias, como la imposición de visas y procesos exclusivos de legalización, que son contrarios al derecho a la libre movilidad y al principio de ciudadanía universal. Se concluye que las políticas implementadas vacían de contenido el principio de ciudadanía universal, convierten la excepción en norma y promueven la ilegalidad de la migración, lo que requiere la reconfiguración de la regulación según el bloque constitucional.
