| Résumé: | This graduation thesis aims to analyze the criminal offense of sexual extortion, as regulated under Article 172.1 of the COIP, to determine whether its current normative configuration provides sufficient criminal protection for the constitutional rights to sexual integrity and privacy in light of new forms of commission facilitated by digital technologies. The objective is based on the need to overcome the legislative omission that afflicts the legal type, since the core verbs employed do not expressly contemplate cases where, even with apparent initial consent, photographic, video, or similar materials are subsequently used as a means of blackmail to obtain a personal benefit or for third parties. This omission forces recourse to extensive interpretations, a practice strictly prohibited by Article 13 of the COIP, which expressly forbids the use of analogy to create criminal offenses, expand the limits of the legal assumptions that allow the application of a sanction, or establish restrictions on rights. It is concluded that, as a proposal, the reform should be addressed by updating the core verbs of the legal type to include new digital forms of commission, without this implying an analogy in malam partem, but rather a normative adjustment required by the Constitution, the Belém do Pará Convention, and the Budapest Convention. | Description: | La presente tesis de grado tiene como objetivo analizar el tipo penal de extorsión sexual, regulado en el artículo 172.1 del COIP, a fin de determinar si su actual configuración normativa ofrece una protección penal suficiente a los derechos constitucionales de integridad sexual e intimidad frente a las nuevas modalidades de comisión facilitadas por las tecnologías digitales. El objetivo se fundamenta en la necesidad de superar la omisión legislativa de la que adolece el tipo penal, toda vez que los verbos rectores empleados no contemplan expresamente los supuestos en los que, aun, existiendo, en apariencia, un consentimiento inicial, los materiales fotográficos, videográficos o de similar índole son posteriormente utilizados como medio de chantaje para obtener un beneficio personal o para terceros. Esta omisión obliga a recurrir a interpretaciones extensivas, práctica estrictamente prohibida por el artículo 13 del COIP, que prohíbe expresamente utilizar la analogía para crear infracciones penales, ampliar los límites de los presupuestos legales que permiten la aplicación de una sanción o establecer restricciones a los derechos. Se concluye que, como propuesta, la reforma debe abordarse mediante la actualización de los verbos rectores del tipo penal para incluir las nuevas formas de comisión digital, sin que ello implique una analogía in malam partem, sino una adecuación normativa exigida por la Constitución, la Convención de Belém do Pará y el Convenio de Budapest. De esta manera, se garantiza una protección penal efectiva. |
