El derecho a la libertad de expresión e información respecto de las actuaciones de sujetos públicos, al tenor de lo establecido por la Corte Interamericana de Derechos Humanos.

Abstract

The objective of this study is to outline the main content of the Right to Freedom of Expression and Information, analyzing the different legal treatments that the expressions and information receive when they refer to public officials or public figures. The analysis is made following the doctrine and jurisprudence of the Inter -American Court of Human Rights, examining it with our domestic legislation as well as the proceedings of the authorities which must implement them, in order to determine if they comply or not with the parameters set by it according to the Right to Freedom of Expression. It was found that the Ecuadorian State disregarded the duties set by the American Convention of Human Rights (The Convention) due to the existence of norms and proceedings of authorities that contravenes the free exercise of the right above mentioned.
