| Résumé: | The present investigation focuses on analyzing the scope of the constitutional control that the State would have, through the extraordinary protective action in the cases of arbitral awards issued by Arbitral Tribunals with respect tothe direct submission of this jurisdictional guarantee in cases when it is not possible to submit a nullity action for failing to fit into its grounds provided in Article31 of the Arbitration an Mediation Law, or to the possible violation of constitutional rights; as well as the analysis of the cases in which the nullity action would proceed, depletion of arbitration resources. |
| Description: | La presente investigación se enfoca en analizar el alcance del control constitucional que tendría el Estado, a través de la acción extraordinaria de protección en los casos de laudos emitidos por Tribunales Arbitrales con respecto a la interposición directa de esta garantía jurisdiccional en casos cuando no es posible interponer una acción de nulidad por no encuadrarse en sus causales taxativas previstas en el Art. 31 de la Ley de Arbitraje y Mediación, o ante la posible vulneración de derechos constitucionales; así como el análisis de los casos en que si procedería la acción de nulidad como agotamiento de recursos en materia arbitral. |
