Abstract

To talk about inheritance law and the possibility to save the rights of the animals and offer the possibility to be subject of law, it is the topic that want to cover. This brief analysis seeks to clarify those doubts that have arisen as a result of the current Constitution where it declares as subject of right to nature, opening the possibility that the animal, the pet, can acquire inheritance rights, the subject of the testamentary assignments with in the Codigo Civil and its influence on the Ley Organica de Bienestar Animal (LOBA), which grants rights to animals but limited to the right of protection. What proves the existence of a gap regarding the issue.
