Análisis del uso y aplicación de la extinción y reforma de los actos administrativos y su repercusión en el ejercicio de la institucionalidad del estado en la prestación de servicios.

Abstract

This investigation has been based on the analysis of the use and application of the extinction and reform of the administrative acts that are in force and that have been reformed through the legal bodies destined to their regulation according to the administrative organs in all their levels; therefore, the review of administrative acts provides a means to ensure that the other branches of government operate within the power granted to them by the Law and the Constitution. To ensure this, the administrative control bodies of the State serve as protectors from the possible abuse by administrative entities such as the Decentralized Autonomous Governments (DAG), especially in administrative acts for which they are responsible from their jurisdictions. The objective is to conduct an investigation and analysis of the extinction and reform of administrative acts, through the study of resolutions, with the premise of establishing regulated procedures for the central administration for the benefit of the interests of the administrated and the State. The research methodology is of the inductive - deductive type, with the purpose of identifying the mechanisms that hinder extinction, revocation or challenge. The results of the review of the resolutions studied, have determined that the requirement of notification requires the State to inform the person sought to be deprived of a right thus constituting the beginning of acceptance or challenge that may be subject to the administrative act, in a possible nullity or extinction and the application of legal responsibilities.
