La necesidad de transformación del Club Deportivo a Sociedad Anónima Deportiva conforme a la realidad Ecuatoriana.

Abstract

Within the Ecuadorian sport we find that the figure of the sports club has been the one that has characterized the civil association with the purpose of recreation and access to sports; but we have witnessed the growing mercantility that this activity, previously understood as playful, has suffered. Reason why, it is necessary to rethink the sports association as the group that pursues not only sporting purposes, but also economic purposes both in form and in substance; leaving in evidence the rethinking that must be done within the Ecuadorian legislation in order to safeguard, not only those who are understood as club members or their respective directives, but also those who seek to be investors and increase both the sports performance and the profits within of that association. The insertion of the institution of the Public Limited Sports Company, which aims not only to be considered within our legislation, but also to present a new aspect in the sports law, is leaving to the light of the right the needs to restructure fundamental rules within the economic, corporate-mercantile and criminal sphere, which would entail that this figure seeks not only to fulfill the social purpose of the sport, but also to present an attractiveness for financing it.
