Análisis jurídico del sistema de contratación pública por parte de la Prefectura de la provincia de Sucumbíos del Ecuador.

Abstract

“Legal Analysis of the Public Procurement System by the Prefecture of the province of Sucumbíos del Ecuador” This degree project is an investigation that addresses a study; and, analysis of the contracts for the execution of public works in the seven cantons of the Province of Sucumbíos and that are in charge of the Prefecture of Sucumbíos of Ecuador; initiated with the legal analysis of the constant historical problems in public contracts that appear within this territory, due to the following: Lack of planning by bidders, Failure to update information in the “Unique Registry of Suppliers” within ten days of the modification, Legal gaps within the regulation of procedures that lead bidders to fall in constant infractions, Normative dispersion, Lack of better articulation within the LOSNCP electronic system.The purpose of this project is to provide information for an adequate process of control in hiring carried out by the Prefecture of Sucumbíos, in order to overcome past situations that generated serious events of force majeure, classified as a fortuitous case; whose items there is a history of the bidders requesting extensions to comply with the requirements determined by the "Organic Law of the National System in Public Procurement." Correct application of the constitutional principles in public procurement and proposal of a reform to IBIDIM “A” of article 106 of the Organic Law of the National System in Public Procurement.
