Abstract

The Organic Law on Entrepreneurship and Management represented a great advance in terms of state policies to promote entrepreneurship and the creation of new sources of income, giving the entrepreneur better options for the growth of his business and the possibility of setting up a company whose main characteristic was the privacy of the documents and the administrative simplicity to constitute it and register its corporate acts; however, the quick creation of this new type of company resulted in the fact that the regulatory bodies that govern it (Companies Law and the SAS Regulations) contain contradictions regarding the participation of this new type of company in the market. of securities, which generates confusion because the current regulations have left this aspect without a specific regulation.
