| Résumé: | After the reform of article 363 of the COGEP in which the mortgage is included as a foreclosure title which must have executable obligations, we will base ourselves on characteristics that define which mortgage is suitable to be considered a foreclosure title, keeping in mind that no Any mortgage can be considered, so the obligation contained must be clear, pure, determined and currently enforceable, being limited to the specific realization of those established in the execution title. In the following work, the mortgage and the circumstances that must be adapted to work as a title of execution will be analyzed. |
| Description: | Tras la reforma del artículo 363 del COGEP, en la que se incluye la hipoteca como título de ejecución, la cual debería tener obligaciones ejecutables; analizaremos las características que definen que hipoteca es apta para ser considerada título de ejecución, teniendo en claro que no toda hipoteca puede ser considerada como título de ejecución, por lo que la obligación que se contiene debe ser pura, determinada y actualmente exigible, considerando que la ejecución se limitada a la realización concreta de los establecido en el título de ejecución. En el siguiente trabajo se analizará la hipoteca y las circunstancias que hay que adecuarlas para que funcionen como título de ejecución correctamente. |
