Abstract

In this investigation, the purpose of analyzing and justifying the design andimplementation of a specialized justice system of prosecutors and judges of criminal guarantees with reserved identity is established in order to preserve their safety, personal integrity and their lives so that they can develop with their tasks ofadministering justice and combating organized crime without pressure. The legal problem that is addressed is due to the fact that currently the levels of insecurity have reached the point where criminal organizations have threatened and claimed the lives of prosecutors and judges for not favoring them with their decisions and rulings in the investigation of crimes., which affects the performance of their functions, generating impunity and insecurity for citizens. Therefore, the objectiveof this investigation is to establish proposal mechanisms for this system in order to guarantee the confidentiality of the identity of prosecutors and judges of criminal guarantees at all levels, so that they can fulfill their duty in accordance with the right and with the proper security conditions to protect citizens. A qualitative investigation has been carried out with support from sources of doctrine, legal norms and interviews with experts that allow expanding the content and foundationsof this investigation. The results show that the proposal is feasible, but it requires profound regulatory and structural changes so as not to affect the guarantees of dueprocess, according to the Constitution, the COIP and human rights.
