El caso Isaías a la luz del derecho nacional e internacional.

Abstract

This work is titled 'The Isaías case, in the light of national and international law'. The problem that is going to be analyzed is the legal effect that the existing rulings in the case have had and their impact on the pursuit of Rights and respect for private property. From this, the work is divided into 3 chapters: the first is aimed at the analysis of the local legal reality, through a constitutional and civil analysis of the aforementioned legal situation; Chapter 2 will examine opinion 2244/2013 of the UN Human Rights Committee and its effect at the international level, specifically, with Ecuador as a state party to the organization, the third chapter will conclude with respect to what was demonstrated in the study and how, despite the non-binding nature of the opinion, it generated an important legal question.
