| Résumé: | This work is titled 'The Isaías case, in the light of national and international law'. The problem that is going to be analyzed is the legal effect that the existing rulings in the case have had and their impact on the pursuit of Rights and respect for private property. From this, the work is divided into 3 chapters: the first is aimed at the analysis of the local legal reality, through a constitutional and civil analysis of the aforementioned legal situation; Chapter 2 will examine opinion 2244/2013 of the UN Human Rights Committee and its effect at the international level, specifically, with Ecuador as a state party to the organization, the third chapter will conclude with respect to what was demonstrated in the study and how, despite the non-binding nature of the opinion, it generated an important legal question. |
| Description: | El presente trabajo se titula ‘El caso Isaías, a la luz del derecho nacional e internacional’. El problema que va a analizar es el efecto jurídico que han tenido las sentencias existentes en el caso y su repercusión en la prosecución de Derechos y el respeto a la propiedad privada. A partir de esto, el trabajo se divide en 3 capítulos: el primero, va encaminado al análisis de la realidad jurídica local, por medio de un análisis constitucional y civil de la situación jurídica mencionada; el capítulo 2 examinará el dictamen 2244/2013 el Comité De Derechos Humanos de la ONU y su efecto a nivel internacional, de forma específica, con Ecuador como estado parte de la organización, el tercer capítulo concluirá respecto de lo demostrado en el estudio y como, a pesar del carácter no vinculante del dictamen, este generó un importante cuestionamiento jurídico. |
