Abstract: This degree project analyzes the impugnability of expropriation within the Ecuadorian legal system, focusing on the tension between administrative power and the constitutional guarantees of the individual. Through a historical overview spanning from Roman Law to the 2008 Constitution, the study examines the coercive nature of this legal figure and its constitutive elements, such as public utility and just compensation. The core of the analysis addresses the legal problem generated by Article 63 of the Organic Law of the National Public Procurement System, which restricts the challenge of the administrative act solely to the determination of the price, thereby limiting the essential core of the right to appeal and effective judicial protection. Finally, it is concluded that such a limitation violates the right to a defense in the constitutional warranty of right of appeal, proposing a legal reform to allow for comprehensive judicial control over the legitimacy and the need of the declaration of public utility to prevent arbitrary or confiscatory acts.
Description: En este trabajo de titulación se analizará la impugnabilidad de la expropiación en el ordenamiento jurídico ecuatoriano, enfocándose en la tensión existente entre la potestad administrativa y las garantías constitucionales del particular. A través de un recorrido histórico desde el Derecho Romano hasta la Constitución de 2008, el estudio examina la naturaleza coactiva de esta figura y sus elementos configurativos, como la utilidad pública y la justa indemnización. El núcleo del análisis aborda el problema jurídico generado por el artículo 63 de la Ley Orgánica del Sistema Nacional de Contratación Pública, el cual restringe la impugnación del acto administrativo únicamente a la determinación del precio, limitando así el núcleo esencial del derecho a recurrir y la tutela judicial efectiva. Finalmente, se concluye que dicha limitación vulnera el derecho a la defensa en su garantía del derecho a recurrir, proponiendo una reforma legal que permita un control judicial integral sobre la legitimidad y necesidad de la declaratoria de utilidad pública para evitar actos arbitrarios o confiscatorios.
