Titre: El sistema notarial ecuatoriano y la seguridad jurídica en relación con los actos y negocios electrónicos.

Résumé: The present research work seeks to explain how the demands of an increasingly globalized world face law as the regulating entity of social relations. In recent years, Information and Communication Technologies have had a modifying impact on the way in which information is accessed, these changes have had an impact on all professional branches, without exception, and have involved mechanisms for adapting to this new reality. The New Technologies of Information and Communication have imposed new challenges and, as it could not be otherwise, they have also created a more complex, but democratized reality with respect to access to information. This new reality is not only technological, but also sociocultural, so it is linked as fields such as economy, politics and the legal system of each State. Among the institutions, principles and branches affected by these technological and sociocultural changes is the notary public, from which the figures and concepts of Notary, Notarial Law and Legal Security emerge. This last concept is derived from the very genesis of the Notarial Function whose essential task is to process the requirements of those who come to it. Rodríguez (2016), referring to Legal Security, states that "the only way to perpetuate wills is by means of capturing facts, so that they can later know their content, preserve it in an enduring and transcendent manner" (Mora, cited by Rodríguez, 2016). In this sense, the constant technological changes that the world is going through require new ways to preserve human events, that is, new means of durability that, unlike physical ones, their form of presentation is virtual. Now, faced with this accumulation of changes that the current context obliges to implement, there is uncertainty or, more specifically, a kind of notarial fear in what refers to Legal Security. Precisely, the function performed by the notary is defined by the legal security that guarantees society, so that technological changes generate particularly doubts about security in legal business, doubts that require answers to prevent difficulties that are generated by the existence of normative gaps. That said, this academic work supports the thesis that the use of technology in the Ecuadorian notarial system is beneficial as long as the Legal Security does not run any risk, hence the need to make the necessary adjustments to the Ecuadorian legislation so that Legal Security is not undermined by the use of documents and electronic signatures as mechanisms of innovation and speed in notary processes, especially in electronic business.
Description: El presente trabajo de investigación busca explicar cómo las exigencias de un mundo cada vez más globalizado enfrentan al derecho como el ente regulador de las relaciones sociales. En los últimos años, las Tecnologías de la Información y Comunicación han tenido un impacto modificador en la manera en la que se accede a la información, estos cambios han repercutido en todas las ramas profesionales, sin excepción alguna, y han supuesto mecanismos de adaptación a esta nueva realidad. Las Nuevas Tecnologías de la Información y Comunicación ha impuestos nuevos desafíos y, como no podría ser de otra forma, también han creado una realidad más compleja, pero democratizada con respecto al acceso a la información. Esta nueva realidad no es solo de orden tecnológico, sino de también sociocultural, por lo que se vincula como campos como la economía, la política y el ordenamiento jurídico de cada Estado. Entre las instituciones, principios y ramas en las que inciden estos cambios tecnológicos y socioculturales se encuentra el notariado, de donde se desprenden las figuras y conceptos de Notario, Derecho Notarial y Seguridad Jurídica. Este último concepto se deriva de la propia génesis de la Función Notarial cuya tarea esencial consiste en dar trámite a los requerimientos de quienes acudan a él. Rodríguez (2016), refiriéndose a la Seguridad Jurídica, platea que “la única manera de eternizar las voluntades es por medio de la captación de hechos, para que permitan con posterioridad conocer su contenido, conservarlo en forma perdurable y trascendente” (Mora, citado por Rodríguez, 2016). En este sentido, los constantes cambios tecnológicos que atraviesa el mundo requieren de nuevas formas para conservar los hechos humanos, es decir, nuevos medios de perdurabilidad que, a diferencia de los físicos, su forma de presentación es virtual. Ahora bien, ante este cúmulo de cambios que el contexto actual obliga a implementar, surge incertidumbre o, más concretamente, una especie de temor notarial en lo que se refiere a Seguridad Jurídica. Precisamente, la función que desempeña el notario se define por la Seguridad Jurídica que garantiza a la sociedad, por lo que los cambios tecnológicos generan particularmente dudas sobre la seguridad en los negocios jurídicos, dudas que requieren respuestas para prevenir dificultades que se generan por la existencia de vacíos normativos. Dicho lo anterior, este trabajo académico sostiene la tesis de que el uso de la tecnología en el sistema notarial ecuatoriano es beneficiosa siempre y cuando la Seguridad Jurídica no corra ningún riesgo, de allí la necesidad de realizar las adecuaciones necesarias a la legislación ecuatoriana para que la Seguridad Jurídica no se vea menoscabada ante el uso de documentos y firmas electrónicas como mecanismos de innovación y celeridad en los procesos notariales, sobre todo, en los negocios electrónicos.
