Abstract: On the enforcement of the notarial service was created the “ Sistema electrónico notarial” to enter, have control, verify acts & contracts and assignments that have each notary, is still the same physical medium books. Although the approach of the notary activity to the community and the use of computer tools have been not simplified notarial procedures due to misapplication of the ICT and certain solemnities on the “Ley Notarial”. The globalization has gone beyond under that there are contractual obligation made by thousands of people daily through electronic device, which should be regulated by the law rules and have legal certainty in all its stages. Since the creation of the “Ley de Comercio Electrónico”and the implementation of the platform of the “ Sistema electrónico notarial” been more than 10 years where the law does not provide legal certainty to electronic contracts, neither has not allowed bring the services closer to the users causing the existing platform to be useless for the execution of the notarial function. We wonder if the notarial activity has been established in the current legislation to protects such complex transactions such as electronic contracts. As well as if the notary guarantees legal certainty in such contracts. These issues could be resolved with the implementation of the electronic notary which allows to provide legal certainty to legal e-business in addition saving resources and agility in the paperwork. Countries such as Spain, Chile, Mexico, Argentina, Uruguay, etc have begun with the implementation of electronic notaries, also known as cibernotariado or digital notary. Legal figures that have been using in other countries for the implementation of the e-notary, are the same that we have in our legislation, such as the electronic signature, electronic contracts and e-documents. We find that our country needs unification of legal rules, extension of powers to notaries and the use of existing technologic tools.
Description: En el ejercicio del servicio notarial el Sistema electrónico notarial fue creado para registrar, controlar y verificar los actos, contratos y diligencias celebrados o registrados en cada notaria que hasta la actualidad constan en los libros físico de protocolos, diligencias y otros actos notariales. Pese al acercamiento de la actividad notarial a la comunidad y la utilización de herramientas informáticas no se han simplificado los trámites notariales debido a la mala aplicación de las TIC's y ciertas solemnidades existentes en la legislación notarial. Pero esta globalización ha ido más allá en virtud de que existen obligaciones contractuales que miles de personas realizan a diario mediante medios electrónicos, los cuales deberían ser reguladas por la normativa y gozar de seguridad jurídica en todas sus etapas. Desde la creación de la Ley de Comercio Electrónico y la ejecución de la plataforma del Sistema Informático Notarial hasta la actualidad han pasado más de 10 años donde la legislación no brinda seguridad jurídica a los contratos electrónicos, ni tampoco ha permitido acercar a los usuarios los servicios notariales causando que la plataforma existente sea inútil para la ejecución de la función notarial. Nos cuestionamos si la actividad notarial establecida en la normativa vigente tutela transacciones tan complejas como son los contratos electrónicos. Así como si el notario garantiza la seguridad jurídica en dichos contratos. Estas problemáticas podrían resolverse con la implementación del notariado electrónico el cual permite brindar seguridad jurídica a negocios jurídicos electrónicos adicionalmente de ahorro de recursos y agilidad en los tramites. Países como España, Chile, México, Argentina, Uruguay, etc han empezado con la implementación de notarías electrónicas también conocidas como cibernotariado o notaria digital. Se han identificado figuras jurídicas que han sido las bases para la implementación del notariado electrónico en otros países mismas que por si solas existen dentro de nuestra legislación, como son la Firma electrónica, Contratos electrónicos y Documentos electrónicos, Protocolos digitales. En virtud de la presente encontramos que en nuestro país es necesaria una unificación de normativas jurídicas, ampliación de competencias a los notarios y el uso de las herramientas informáticas existentes.
