La actuación del notario frente a los actos contenidos en medios electrónicos contemplados en la legislación ecuatoriana, y su aporte a la seguridad jurídica.

Abstract

Throughout history, the development of trade and comercial legislation accompanies it, has certain characteristics, which ultimately fit the reality of each country. In the mid-twentieth century, that the use of computers and with tha of computer science, denote an unusual development and transformation, being born thus the information Age or Information Society. In this stage, the Internet is born as a computer network system that would allow information to be exchanged in real time. In this technological development, major changes take place in society (digital revolution), wich originates a transformation at all levels: economic, social, legal, political, among others, giving way to a new way of understanding trade. The Notary as a legal profesional, must take into account legal acts, in which today he is currently facing the technological challenge present in society, for which he requieres a legal framework tha provides the assurances for his profesional perfomance, especially in the acts of improvement tha support their actions. It can contribute to the strengthening of the National Public Registry of Certification Entities for Accredited Information and Related Services and related third parties, proposing that the National Telecommunications Secretariat issue the regulations that allow its organization and operation. In these frameworks, this work deals with the analysis of the actions of the Notary in relation to the acts contained in electronic means contemplated in the Ecuadorian Legislation and in the Notary Law, contributing with solutions for the strengthening of legal security.
