La responsabilidad civil de los notarios en la materializacion de un contrato de compraventa electrónico.

Abstract

Notaries are civil servant to whom the State has given them the power to certify the copies of the documents that are exhibited to them, as well as their conformity and accuracy. Likewise, they are granted the faculty to give faith regarding the documents that are generated or obtained by means of computer systems. With regard to the latter, the present complex review contemplates a brief historical analysis of the sale from its beginnings to the present; the legal framework of the trade agreement in Ecuador; the requirements and solemnities for the execution of the purchase agreement; the scope of the faculty of notaries in the materialization of electronic documents in Ecuador; and finally, the civil and administrative effects of the notary in the intervention of an invalid electronic sales contract under the current legislation in Ecuador.
